US Midterms Lock In America's State-by-State AI Rules
United States: the AI compliance framework that answers this
$997/year
Democrats now control both houses of Congress. The plan to override state AI laws with one federal rule has almost no road left, so the state laws are here to stay.
On 3 November 2026, Democrats won control of both the House and the Senate, as reported by CBS News and NBC News. Two days later, fears of new AI rules wiped more than $2 trillion off US tech stocks, as reported by NPR.
The share price is the headline. For businesses that use AI, the bigger change is what now will not happen.
The federal override has almost no road left
On 11 December 2025, Executive Order 14365 asked Congress for a federal standard that would override conflicting state AI laws. The order repeals no state law itself. Only Congress can do that, and most legislation needs 60 votes in the Senate.
With Democrats running both chambers from January, that standard has little route to becoming law. The order's other half, a Justice Department task force to challenge state AI laws in court, carries on, but a court case moves one law at a time.
So the state-by-state picture is not a phase. It is the system.
The state laws already on the books
- Texas: HB 149, the Responsible Artificial Intelligence Governance Act, in force since 1 January 2026, covering prohibited uses, government AI disclosure and Attorney General enforcement.
- Illinois: Public Act 103-0804 (HB 3773), in force since 1 January 2026. An employer that uses AI in recruitment, hiring, promotion, discipline or discharge must tell employees, and AI that discriminates against a protected class is a civil rights violation.
- Colorado: SB 26-189 takes effect on 1 January 2027, with duties for developers and deployers of automated decision-making technology used in consequential decisions.
More states are writing their own. A firm using AI with clients in several states answers to each of them, and nobody in Washington is going to simplify that.
What this means for your firm
If you use AI with US clients, waiting to see what Congress does is not a plan. The laws that apply to you are already on the books. Keep a written record of which AI tools you use, what data they handle, who checks their output and what you do when it gets something wrong, and check that record against each state you work in.
If you sell into Europe, none of this changes anything. The EU AI Act is already law.
