Three Compliance Fronts UK Professional Services Must Defend in 2026

The EU AI regulatory landscape shifted considerably in the first half of 2026. For UK professional services firms — accountants, solicitors, HR consultancies, marketing agencies — that still operate across European markets or handle EU residents' data, the changes are not distant policy developments. They are live compliance obligations with enforcement consequences attached.

Three fronts now demand immediate attention: the governance of agentic AI systems, the escalating enforcement risk around AI and copyright, and the very personal liability exposure facing senior executives whose organisations become repeat offenders. Each front requires a different operational response. None of them can be managed by a policy document alone.


On 26 March 2026, the European Parliament adopted its position on the Digital Omnibus on AI, opening trilogue negotiations with a target of reaching a final agreement by May 2026. Among the notable developments is the proposal to delay core high-risk AI compliance deadlines to December 2027 and August 2028 — a concession to businesses seeking legal certainty. However, one deadline has been fast-tracked: the requirement to watermark AI-generated content is expected to apply from 2 November 2026.

But before firms focus on watermarking, there is a more immediate structural problem to address: autonomous AI agents.

Spain's data protection authority (AEPD) and the Dutch Data Protection Authority both issued guidance on agentic AI in early 2026. Their position is unambiguous. When your firm deploys an AI agent that autonomously books meetings, queries third-party APIs, processes client data, or triggers workflows without human sign-off at each step, your organisation remains fully accountable as the data controller under the GDPR. The autonomy of the system is not a mitigating factor. It is, if anything, an aggravating one.

For professional services firms, this matters considerably. Accountancy practices are integrating AI agents into tax workflows. Solicitors are trialling autonomous research tools that pull from external databases. HR consultancies are using AI to screen candidates and schedule interviews. Marketing agencies are deploying agents that generate, schedule, and publish content with minimal human review.

In every one of these scenarios, your firm is responsible for what the agent does with data — including data it accesses through third-party integrations you did not build and may not fully understand.

The practical obligation is threefold. First, map every data flow your agents touch, including outbound API calls to external systems. Second, ensure those external systems are contractually and technically reliable as processors or controllers in their own right. Third, define and enforce strict data retention rules at the agent level — autonomous systems left to accumulate data will eventually create a GDPR liability that is difficult to remediate quickly.


On 10 March 2026, the Court of Justice of the EU held its first-ever hearing on generative AI and copyright in Like Company v Google (Case C-250/25). The central question is whether training large language models on copyrighted material constitutes unauthorised reproduction under EU law. A ruling is anticipated later in 2026, and whichever way it goes, it will establish a precedent that ripples far beyond the technology sector.

In parallel, the Irish Data Protection Commission launched a formal inquiry in April 2026 into X's use of public posts from European users to train its Grok AI model. This matters not just for social media platforms but for any organisation that has fed proprietary or third-party content into AI systems — whether as training data, fine-tuning input, or repeated prompting that effectively teaches a model your firm's client-specific methodology.

UK professional services firms tend to underestimate their exposure here. Many have integrated third-party AI tools into their core workflows and have not thoroughly audited what those tools were trained on or what happens to the data they process. If a solicitor's firm uses an AI drafting tool trained on court documents that may have been scraped without authorisation, the firm's use of that tool may eventually be implicated in downstream litigation or regulatory scrutiny.

The immediate action is not to stop using AI tools — it is to conduct vendor due diligence with intellectual property in scope, not just data protection. Request documentation from AI vendors on training data provenance. Ensure contracts include warranties about lawful data acquisition. Where firms produce AI-generated outputs for clients, begin preparing for the November 2026 watermarking requirement now, rather than treating it as a future concern.


Front Three: Executive Liability Is No Longer a Hypothetical

The Clearview AI enforcement action by the Dutch Data Protection Authority represents a significant shift in regulatory approach. Alongside a €30.5 million corporate fine for illegally scraping biometric data, the authority is pursuing the company's directors personally for the violations. This is not standard practice — and that is precisely the point. It signals that regulators are prepared to escalate accountability for chronic non-compliance directly to individuals.

For senior partners, managing directors, and data protection leads at UK professional services firms, this development warrants a clear-headed conversation about personal governance obligations. GDPR accountability already sits at board level in principle. What Clearview AI demonstrates is that it can sit there in practice, with personal financial and reputational consequences.

There is a second accountability development worth noting. Following the CJEU ruling in Dun & Bradstreet (Case C-203/22), firms that use automated decision-making for credit scoring, pricing, or recruitment can no longer rely on trade secret protections to refuse explaining their algorithmic logic to affected individuals. If your firm uses AI-assisted tools in client onboarding, pricing decisions, or candidate shortlisting, you must be able to explain — in plain language — how those decisions were reached. This does not require exposing source code. It does require building explainability into your systems and processes now, before a subject access request or regulatory enquiry forces you to do so under pressure.


The Operational Response: Merge Your Frameworks, Close Your Silos

The firms that will manage these three fronts effectively are those that stop treating GDPR compliance, AI Act readiness, and intellectual property risk as separate workstreams owned by different teams.

Data Protection Impact Assessments and AI Act risk assessments should be conducted in parallel, using harmonised templates. Vendor management processes should include IP provenance checks alongside processor agreement reviews. Executive accountability frameworks should name individuals responsible for AI governance decisions, not just data protection in the abstract.

The Digital Omnibus negotiations will likely conclude by late spring 2026. The final text will bring further obligations. Firms that have already integrated their compliance frameworks will adapt. Those that have not will find themselves running multiple remediation projects simultaneously — an expensive and disruptive position to be in.
