The EU AI Act: legal AI is explicitly high-risk
Most sectors must determine whether their AI use cases fall under high-risk classification through analysis of Annex III. Law firms do not have that ambiguity. The Act explicitly includes in its high-risk list: "AI systems intended to be used by a judicial authority or on their behalf to research and interpret facts and the law and to apply the law to a concrete set of facts."
This is a direct classification. AI tools used in legal research, document analysis for litigation, case outcome prediction, and legal argument generation — where the output influences legal proceedings or advice based on legal proceedings — fall within this classification. Law firms deploying such tools have specific obligations from 2 August 2026:
- Conformity assessment: A documented assessment of the AI system's compliance with the Act's requirements before deployment or continued use.
- Registration: High-risk AI systems must be registered in the EU AI database.
- Technical documentation: Maintained documentation covering the system's design, training data characteristics, intended purpose, and performance metrics.
- Human oversight: A documented mechanism by which a human can monitor, intervene, or override the AI system's output during use.
- Post-market monitoring: Ongoing assessment of how the system performs in real-world conditions, with a reporting mechanism for serious incidents.
Penalties for high-risk AI violations: €15 million or 3% of global annual turnover, whichever is higher. Penalties for supplying incorrect information to enforcement authorities: €7.5 million or 1.5% of global turnover.
Which legal AI tools are in scope
The practical question for most law firms is: which of our current AI tools triggers high-risk classification? The determining factor is purpose and use context, not the tool itself.

GDPR obligations on client data processed through AI tools are active now — they do not wait for the August 2026 EU AI Act deadline. The framework is the same across all member states, enforced by national data protection authorities (the DPAs).
The key obligations when using AI tools that process client personal data:
- Data Processing Agreements: Every AI provider that processes personal data on your firm's behalf is a processor under GDPR. A documented DPA is mandatory — covering data residency, retention periods, sub-processors, and whether data is used to train the AI model.
- Lawful basis: Personal data processed through AI systems requires a documented lawful basis. For client matter data, this is typically contract or legitimate interests — but the assessment must be documented and proportionate.
- Data Protection Impact Assessment: Where AI processing of personal data is likely to result in high risk — as it typically is when legal outcomes are involved — a DPIA is required before deployment.
- Article 22 — automated decisions: Individuals have the right not to be subject to decisions based solely on automated processing that produce legal or similarly significant effects. Any AI-driven legal assessment that directly influences a consequential outcome must have a documented human decision-making layer.
GDPR penalties: up to €20 million or 4% of global annual turnover, whichever is higher. National DPAs across all EU member states have active enforcement programmes — this is not theoretical.
Professional competence obligations: all bar associations, all member states
Every EU member state bar association has a competence obligation equivalent to the SRA's position in the UK. The specific rules vary, but the underlying principle is universal: legal professionals are responsible for the quality and accuracy of work delivered to clients, including work assisted by AI.
Bars in Germany, France, the Netherlands, Spain, and across the EU have either issued explicit guidance on AI use or applied existing competence rules to AI-generated legal work. The consistent message is:
- AI output must be verified before use in client matters or proceedings
- Solicitor-client confidentiality covers data uploaded to AI platforms — appropriate contractual protections are required
- Responsibility for errors in AI-assisted work lies with the professional, not the tool provider
The sanctioning pattern from courts in the United States, Canada, and the United Kingdom — where legal professionals have been fined for submitting AI-generated hallucinated citations — is being closely watched by European judicial authorities. European courts are beginning to issue their own AI disclosure requirements. Firms that build the review frameworks now avoid the credibility risk of being the precedent-setting case in their jurisdiction.
The transparency obligation: disclosing AI use in proceedings
An emerging and increasingly important obligation for EU law firms is transparency about AI use in court proceedings and arbitration. Multiple European jurisdictions are developing or have already adopted rules requiring disclosure when AI was materially used in preparing submissions, evidence analysis, or legal arguments.
The EU AI Act also contains transparency requirements for AI systems that interact with natural persons — including AI-assisted client communications and chatbots. Any AI that presents itself in a way that could be mistaken for a human must be clearly identified as AI to the user.
